Thank you for using Cadenza Mobile GIS 2go! The present terms of use shall govern the use of the GIS 2go software and the access to the GIS 2go services and their use. Please read the terms and conditions carefully before using the software and the services. By using the GIS 2go software and services you agree to be bound by these terms and conditions. If you use the software and services on behalf of an organisation, you will accept the terms and conditions on behalf of this organisation and confirm that you are authorised to agree to these terms on behalf of the organisation. In this case, the use of "you" and "your" in the text below refers to this organisation.

Our services

By creating a free account for the GIS 2go services, you will be provided with the following services: (1) You will receive a non-exclusive, non-transferable and revocable license to use the GIS 2go software, as long as you have a valid account for the GIS 2go services. (2) You can use the GIS 2go services for downloading and uploading your mobile maps from the Cadenza Mobile app and use the desktop software, as long as you have a valid account for the GIS 2go services. The features mentioned in your specific package shall apply.

Service levels for GIS 2go services

Service hours: The service hours are from Monday to Friday, from 6.00 a.m. - 6.00 p.m. (Central European Time); except public holidays in Baden-Wuerttemberg (Germany). Outside these service hours, regular maintenance and data backup services may lead to usage restrictions.

Availability of the server services: The server services are available at least 99% during the annual service hours, excluding downtime due to scheduled maintenance work (see below "Maintenance and maintenance window") or due to technical or other problems which are beyond our control (e.g. force majeure, downtime of networks provided by other operators). Access to our services may be limited inasmuch as such limitation is required for the purposes of ensuring the reliability of network operations, the maintenance of network integrity, particularly the prevention of serious disruptions of the network, the software or stored data.

Recovery of services: In the event of downtime or data loss, recovery of the services will be executed no later than 8 hours after notification of the incident during the service hours. Outside the service hours, the recovery period shall be applied from the start of the next service period. When importing the latest data backup for data recovery, some data, which was transferred after data storage, might get lost. Any incident shall be reported immediately to us.

Maintenance and maintenance window: A maintenance window shall be defined for periodical, scheduled or unscheduled maintenance work regarding our services, server providers and their clients required to ensure proper and secure operation or to implement updates. Any disturbance of availability during such work is not considered downtime, but scheduled time for service. System maintenance will usually be performed between Saturday, 12.00 (noon), and Sunday, 12.00 (noon), or every weekday between 11.00 p.m. and 5.00 a.m. In exceptional cases, system maintenance of the running system operation can also be carried out at all other times while keeping the risk of inferior service quality to a minimum.

Failure to perform the service: In the event that we are unable to perform our services due to reasons not attributable to us, e.g. force majeure (in particular war, natural disasters) or due to other unforeseen events at the time of contract conclusion (e.g. lawful strikes, unavailability of a service provider), we shall be released from our performance obligation for the duration of the hindrance. If the failure to perform continues to persist, each of the parties shall be entitled to contract cancellation.

Data privacy statement

We save and use your personal data for setup and operation of the GIS 2go services as well as for contact purposes. If you have subscribed to our newsletter, we also use your e-mail address to send you our latest news. We do not pass on your personal data to third parties.

By using the GIS 2go services, you save mobile maps and change files to Disy's servers. You remain the sole owner of your content. We make no ownership claims to this content.

Disy employees are not permitted to view the content of the files saved to your GIS 2go account. Individual employees of Disy, obligated to protect your privacy, are solely authorized to view file meta data (e.g. file names and sizes) for administration purposes.

Your responsibility

Not Disy, but you are responsible and liable for all content you upload, download or use in other ways connected to our server services. This includes providing third parties with data of your GIS 2go account. Disy makes backup copies of your data on a regular basis in order to prevent data loss. Nevertheless, you - not Disy - are responsible for administration and protection of your data. Disy is neither liable for loss of or damage to your data, nor for costs and expenses that incur for protection or recovery of your data. Please note: Use the download function of the GIS 2go desktop software to regularly download and save data from the mobile server locally to your computer.

Service provided as is - no warranty

Although we are committed to providing an excellent service, there are certain aspects of service for which we cannot assume warranty. GIS 2go software and services are provided as is, without any warranty or conditions. Their use is at your own risk. We do not assume warranty for marketability or suitability for a specific purpose. Disy shall not be liable for damages to your computer system, loss of or damage to your data, or other damages that result from your access or use of the services or software.

Limitation of liability

Where legally permissible, Disy shall in no event be liable for any indirect, individual, incidental, consequential damages or compensation for damages (including loss of use, data, business or profits).
